eSensual Networks takes your privacy very serious. This Privacy Policy describes how we use and do not use information provided to us by our clients who have opened a hosting account with us, and the steps we take to protect it. This Privacy Policy only applies to information collected online. Visitors to the site only have an IP address in our server log which is used only for traffic statistics by our system administrator.
Information We Collect from Our Clients
When you open a hosting account with eSensual Networks, we ask for your name, address, phone number, email address and other personal information. For purposes of billing, you will need to provide your credit card type, number, expiration date and billing address for the card.
How We Use This Information
We use the contact information you provide us with to establish our service for
you. We use payment information for payment processing purposes only. We create
and maintain other information such as customer account status, choice of
services and customer logs in the normal course of providing a
service.
We will not disclose customer personal and account information unless we have reason to believe that disclosing such information is necessary to identify, make contact with or bring legal action against someone who may be causing harm or interfering with the rights or property of eSensual Networks, our customers, or others, or where eSensual Networks has good belief that the law requires such disclosure.
eSensual Networks will not, except for reasons stated below, disclose to third parties the contents of any electronic mail or other electronic communications that eSensual Networks stores or transmits for its customers. The circumstances under which eSensual Networks will disclose such electronic customer communications are when:
1. It is necessary to protect the legitimate interests of eSensual Networks and its customers
2. It is required to cooperate with interception orders, warrants or other legal processes that Host way determines in its sole discretion to be valid and enforceable
3. It is necessary to provide to a law enforcement agency when the contents are inadvertently obtained by eSensual Networks and appear to appertain to the commission of a crime.
eSensual Networks disclaims any intention to censor, edit or engage in ongoing review or surveillance of communications stored on or transmitted through its facilities by customers or others. eSensual Networks will, however, review, delete or block access to communications that may harm eSensual Networks, its customers or third parties. The grounds on which eSensual Networks may take such action include, but are not limited to, actual or potential violations of
eSensual Network's Acceptable Use Policy.
Information Security
We use SSL (Secure Sockets Layer) with a 128 bit length encryption key to insure protection of your credit card information during transmission over the Internet. Your credit card information is stored offline in a secured database which is used for the monthly recurring service fee.

Some sections of our site do use cookies to store session information. These cookies are set only when a client is logged into our Admin Panel and get discarded when he logs out. They are not used for tracking purposes.

Content
All services provided by eSensual Networks may be used for lawful purposes only. eSensual Networks does not monitor, edit, censor, or take responsibility for client content from within the network controlled by eSensual Networks except inasmuch to determine if violations of the AUP have occurred once a suspected violation has been brought to the attention of eSensual Networks. Therefore, clients are solely responsible for the content and use of their service as provided by eSensual Networks and should ensure that such use falls within the guidelines of the AUP.
Child Pornography
The use of eSensual Networks services to store, post, display, transmit, advertise or otherwise make available child pornography is prohibited. eSensual Networks is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of child pornography on, or being transmitted through, its services. |

| Terms and Conditions |
Service Fees. All clients are billed on a 30 day billing cycle starting from the day they sign up for the service. eSensual Networks accepts credit card payments for the monthly recurring service fee if the fee is under $1,000. We also accept bank transfers as well.
Clients who have elected to have pay per minute tracking will be invoiced an additional amount for the Revenue Share at the end of the 30 day cycle. The Revenue Share must be paid no later then 10 days after receipt of invoice. Payment for the Revenue Share can be made either by credit card or bank transfer.
Refund Policy
Refunds will be provided in the same payment method of the original payment.
There are no refunds offered or promised after 30 days. Refunds will be minus the actual bandwidth used. Any refund will automatically close your service account with eSensual Networks.
Cancellations
Cancellations must be in writing or faxed to us 10 days prior to the end of your 30 day billing cycle. We do not prorate our service so no refund will be given for an account closure.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT, AND UNDER NO THEORY OF LAW OR EQUITY, WILL ESENSUAL NETWORKS' (INCLUDING, WITHOUT LIMITATION, ESENSUAL NETWORKS EXECUTIVES, DIRECTORS, OFFICERS, ATTORNEYS, MANAGERS, EMPLOYEES, CONSULTANTS, CONTRACTORS, AGENTS, PARENT COMPANIES, SUBSIDIARIES, CO-SUBSIDIARIES WITH THE SAME PARENT COMPANY AS ESENSUAL NETWORKS, AFFILIATES, THIRD-PARTY PROVIDERS, MERCHANTS, LICENSORS, OR THE LIKE) OR ANYONE ELSE INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING ESENSUAL NETWORKS' SERVICES, BE LIABLE FOR ANY BUSINESS OR PERSONAL LOSS, REVENUES DECREASE, EXPENSES INCREASE, COSTS OF SUBSTITUTE PRODUCTS AND/OR ESENSUAL NETWORKS' SERVICES, OR ANY OTHER LOSS OR DAMAGE WHATSOEVER, OR FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, PUNITIVE OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF ANY USE OF, OR ANY INABILITY TO USE, ANY ESENSUAL NETWORKS' SERVICES EVEN IF ESENSUAL NETWORKS' HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ESENSUAL NETWORKS' TOTAL CUMULATIVE LIABILITY, IF ANY, TO CUSTOMER, OR ANY THIRD PARTY, FOR ANY AND ALL DAMAGES, RELATED TO THE TERMS OF USE OR ESENSUAL NETWORKS' SERVICES, INCLUDING, WITHOUT LIMITATION, THOSE FROM ANY NEGLIGENCE, ANY ACT OR OMISSION BY ESENSUAL NETWORKS OR ESENSUAL NETWORKS' REPRESENTATIVES, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, WILL BE LIMITED TO, AND WILL NOT EXCEED, THE ACTUAL DOLLAR AMOUNT PAID BY THE CUSTOMER FOR THE SERVICES WHICH GAVE RISE TO SUCH DAMAGES, LOSSES AND CAUSES OF ACTIONS DURING THE 3-MONTH PERIOD PRIOR TO THE DATE THE DAMAGE OR LOSS OCCURRED OR THE CAUSE OF ACTION AROSE.

eSensual Networks' service is provided on an as is, as available basis without
warranties of any kind, either express or implied, including, but not limited
to, warranties of merchantability, fitness for a particular purpose or
non-infringement. eSensual Networks expressly disclaims any representation or warranty
that the eSensual Networks' service will be error-free, secure or uninterrupted. No oral
advice or written information given by eSensual Networks, its employees, licensors or the
like, will create a warranty; nor may you rely on any such information or
advice. eSensual Networks and its partners and suppliers will not be liable for any cost
or damage arising either directly or indirectly from any transaction or use of
our service.
Intellectual Property
Customers will not, without eSensual Networks' express written consent, copy, reproduce, republish, or otherwise use any material, in whole or in part, that is located on eSensual Networks' Web site, and customers will not use any of eSensual Networks' trademarks, service marks, copyrighted materials, software, or other intellectual property without eSensual Networks' express written consent. Customers will not, in any way, misrepresent their relationship with eSensual Networks, attempt to pass themselves off as eSensual Networks, or claim that customers are eSensual Networks. |
